ATLANTA, G.A. – The divorce between Real Housewives of Atlanta legend Kandi Burruss and her estranged husband Todd Tucker is escalating quickly — and new court documents show Tucker is making a major move in their custody fight.

According to filings submitted on Wednesday, November 26 and a report by US Weekly, Tucker is now requesting primary physical custody of the former couple’s two young children. The response comes just days after Burruss filed for divorce on November 21.

Tucker, 52, told the court that Ace, 8, and Blaze, 5, are currently living with him in Georgia while Burruss handles “out-of-state work obligations.” He also claimed her schedule will continue to keep her away from home for the “next several months,” suggesting she may not be available to maintain full-time care.





While Tucker emphasized that he wants to work together “in good faith,” he made it clear that if the two cannot reach an agreement, he will seek:

  • Primary physical custody

  • Joint legal custody

  • Final decision-making authority over the children’s upbringing

His attorney noted that Tucker believes Burruss is a “loving and capable parent,” but insisted his priority is stability for the children.

TUCKER QUESTIONS THE COUPLE’S PRENUP

The filings also reveal a brewing conflict over the couple’s prenuptial agreement, which both parties signed before their 2014 wedding.

Tucker acknowledged signing the prenup — but argued that the circumstances surrounding it raise concerns about whether it should be enforced. According to his court response, the final document was presented to him “immediately before the wedding ceremony,” and he claims he did not have legal representation present, despite previous communication between the attorneys on both sides.

In her divorce petition, Burruss listed their date of separation as July 15, 2025, and described the marriage as “irretrievably broken” with “no reasonable hope for reconciliation.”

She is asking the court to:

  • Equitably divide marital debts according to the prenup

Burruss also emphasized that both parents should remain actively involved in their children’s lives.

KANDI’S STATEMENT ON THE SPLIT

Shortly after filing, Burruss issued a statement saying:

“After deep thought and a lot of prayer, I’ve made the decision to move forward with a divorce. This is a difficult and emotional time, but my focus remains on protecting my peace, being the best mother I can be, and co-parenting with love and respect.”

She added that she is entering “a new chapter,” channeling her energy into her family, career, and personal growth. Burruss also expressed gratitude to those who supported the couple throughout their 11-year marriage and asked for privacy as the family navigates the transition.

In a separate interview, Burruss acknowledged that the split had been “brewing for a while.”

Both sides say they want an amicable agreement — but the filings tell a much more complicated story.
