Jaquan Smith said in a sworn statement to California Court of Appeals that Kelsey Harris had a gun in her hands when Megan Thee Stallion was shot on July 12, 2020
In a sworn affidavit, the bodyguard and driver on the night of the alleged shooting of female rapper Megan Thee Stallion stated that Megan’s then-best friend, Kelsey Harris, was holding a gun and that Tory Lanez, born Daystar Peterson, attempted to take the gun from Kelsey when it was fired.
The documents were revealed on Instagram Live by Milagro from Mob Radio, who read the documents in front of her viewers. Tea With Tia later posted the documents to her Instagram feed, and we were able to obtain them.
The document was filed as an affidavit in the Court of Appeal of the State of California, Second Appellate District, Division 3.
On December 5th, Jaquan Smith, bodyguard and driver the night of July 12, 2020, for Daystar Peterson, professionally known as Tory Lanez, gave a statement about what happened on that night. In his statement, Jaquan made it clear that Kelsey Harris, the former assistant and best friend of Megan Pete, who is professionally known as Megan Thee Stallion, was holding a gun.
Jaquan said that on the night of the shooting, he was asked to drive Tory to Kylie Jenner’s residence, where Megan and Kelsey were present. He said that Tory was at Kylie’s house for about two hours when he [Jaquan] received a phone call to come pick up Megan and Kelsey.
In his sworn statement, he stated that he, Megan, and Kelsey had left Kylie’s house. However, Megan later asked him to turn around because she claimed she had left a shoe at Kylie’s place.
Jaquan said that when they arrived back at Kylie’s house, Kelsey stayed in the car, but minutes later, Megan and Tory later returned to the vehicle together.
He made it very clear that Megan was the instigator the entire night.
“Both Ms. Pete, and Mr. Peterson returned to the car after a few minutes,” Smith said in his sworn statement. “Ms. Pete was bickering but I am unsure of the exact words she was saying. She seemed upset. The four of us left Ms. Jenner’s residence.”
The statement continued, and Jaquan said that as he began to drive, Megan started arguing with Tory. Jaquan said Tory and Megan were “going back and forth.”
“I remember Mr. Peterson saying to Ms. Pete that he was going to tell Ms. Harris what was going on,” Smith said in his sworn statement.

Jaquan said that Megan told him to stop the car, and although he couldn’t recall the name of the street where they pulled over, he mentioned that Megan went “to sit on a nearby bus stop.” He said Tory went to talk to Megan, and two minutes later they got back inside the car. Then, he began driving again.

“Ms. Pete started the argument again and Ms. Harris asked what was going on. Mr. Peterson told her that he and Ms. Pete had been dating and intimate, Smith said in his sworn statement.” Megan was upset by this, as she and Mr. Peterson had been dating in the same manner, priot to any relationship with ms. Pete.

In Tory’s December 2022 trial, prosecutors played dirty and used a jail phone call against him, claiming that he admitted to Kelsey Harris the day after the shooting on that call that his apology for what happened was an acknowledgment of firing the gun.
But according to Jaquan’s sworn statement in the quotations above, he remembered Tory telling Megan that he was going to reveal what we now know is that he and Megan were in a sexual dating relationship. If you don’t recall, Tory and Kelsey were initially dating, but Kelsey had to leave Los Angeles and return to Texas where she caught Covid-19.
While she was away, Megan began to flirt with Tory. In the trial, Tory’s defense attorneys argued that he was apologizing on the jail phone call for exposing his sexual relationship with Megan in the car that night, which led to Kelsey pulling out a gun to shoot Megan.
Jaquan said he pulled over to stop the car. He said that Kelsey and Megan both got out of the car and continued to verbally and physically fight.
The only eyewitness to the incident testified that he saw two women fighting, supporting Jaquan’s sworn statement.

“I broke up this fight and was pulling Ms. Pete toward the back of the car,” Smith said.
Jaquan Smith claimed to have seen “Ms. Harris with a gun in her hand.”
“Mr. Peterson and Ms. Harris began struggling as Mr. Peterson tried to unarm Ms. Harris, Smith said in his sworn statement.
He said that he was still holding Megan back and did not see who shot the weapon.
He was thankful that he was not harmed.
“Ms. Pete was also fortunate, Smith said in his sworn statement.
During her testimony in December 2022, Kelsey requested “use immunity,” which was granted. Use immunity protects the witness from having their own testimony used against them.
One noteworthy point in Jaquan’s statement is that he expressed his desire to present it at trial, but the prosecutors claimed that they were not prepared to cross-examine him.
