Substitute Teacher Claims J.H. Rose Staff Member Stood Behind Him in Bathroom

Substitute Teacher

Greenville’s J.H. Rose High School is in the spotlight after a sub claims a teacher stood behind him during a bathroom break.

A bathroom encounter at J.H. Rose High School in Greenville, North Carolina is blowing up on social media after a substitute teacher accused a staff member of standing directly behind him while he was urinating.

The video, posted on TikTok by user @Ziahdadriva, shows the substitute confronting Mr. Herring, a social studies teacher at the school. In his caption, the sub wrote:

“This teacher was standing behind me while I’m actively peeing asking me what am I doing in the staff restroom (I’m a sub). Even if I was a student, no teacher should be standing behind anyone while they are actively using the bathroom. It doesn’t matter the circumstances.”

He described the situation as an invasion of privacy,” “unprofessional conduct,” and straight-up “weird.”

THE CONFRONTATION IN THE HALLWAY

In the original video, Herring is seen walking out of the restroom as the substitute — who is recording — asks for his name. Before answering, Herring asks another teacher in the hallway whether the man is actually a sub. The other staff member confirms it, and Herring then states his name.

Teacher Herring says he questioned the substitute in the staff restroom because he wasn’t wearing ID, adding that students have misused staff bathrooms before.

The sub pushes back, questioning why Herring allegedly waited behind him during such a private moment instead of addressing him after he came out of the stall.

A female staff member jumps in to defend Herring, saying men are often in restrooms at the same time. The substitute quickly replies:

“Okay, but he’s standing dead behind me while I’m using the bathroom.”

She responds, telling the substitute:

“I don’t know… this is a person that works here. He’s a professional and he’s not somebody we question like this. We don’t treat people like this.”

A female staff member defended Mr. Herring in the viral restroom video, saying he acted professionally and that staff shouldn’t be questioned while doing their job.

The exchange has caused mixed reactions online, with some viewers siding with the substitute and others saying they don’t believe it happened the way the sub is trying to paint the narrative.

THE SIT-DOWN WITH ADMINISTRATION

Another video shows a meeting between the substitute, Mr. Herring, Principal Dr. Nydra Jones, and Assistant Principal Marcus Pate. In that video, Herring explains he was on his way to bathroom duty when he stepped inside the staff restroom.

He said the substitute was inside a stall with the door open, and because the man was not wearing a lanyard or ID, he couldn’t tell if he was a student.

“So I asked if he was a student or who he was,” Herring said. “And he goes on to start questioning me and starts recording me.”

The substitute repeated his claim that Herring stood behind him while he was urinating. Herring denied doing anything inappropriate, explaining the open stall door and student restroom misuse concerns.

Principal Jones backed that up, saying the school has dealt with students sneaking into staff restrooms, and Herring was acting within protocol by checking.

She then asked the substitute whether he verbally identified himself as a sub during the bathroom exchange. He said he did not.

SUB REMOVED FROM CAMPUS

Principal Jones ultimately told the substitute that it would be best for him not to finish the day:

“For the sake of peace and not having anything else transpire today… I think it’s best if you don’t finish out the day subbing here. I don’t want any issues happening between the staff members and you.”

Even after that, the substitute continued to ask for Herring’s name, despite the teacher having already given it earlier in the hallway video.

The school has not publicly commented, and no disciplinary decisions have been announced for either party. The video continues to circulate online, with social media users split over who was in the wrong.

  1. The leadership tem committed an Illegal termination without due process or review. The teacher committed sexual harassment and abused his power to protect himself illegally. The deeper issue is that this is an act of sexual harassment, and so leadership has failed to protect the children while illegally terminating the adult victim. Fire leadership, and re-hire or compensate the substitute for damages and financial losses.

  2. Do any of you all know where Wooga at? (Rakheim “Wooga” Prather)

I know some of the people on here know him. He in trouble again. Tell him to turn hisself in.

    1. Shut up, race traitor. Its people like you that give illegals like jose ibarra chances to unalived our white women, but you’re focusing on blacks.

  3. They couldn’t wait for him to finish? What POSSIBLY could have been the immediate rush that they couldn’t wait a few seconds?

    Seriously, weird behavior.

    1. opie is on the downlow or wants some BBC – either way. this is a lawsuit

it is possible to file a discrimination lawsuit if a white teacher follows a Black teacher, stands behind him, and asks him what he is doing there, especially if the behavior is perceived as racially motivated harassment or creates a hostile work environment.

Legal Grounds for a Discrimination Lawsuit

Racial discrimination and harassment in the workplace, including schools, are prohibited by federal laws such as Title VII of the Civil Rights Act of 1964.

Courts often require the plaintiff to demonstrate that the conduct was based on race and was severe or pervasive enough to alter the conditions of employment, creating an environment that a reasonable person would find hostile or abusive.

      Real-World Examples

There are numerous cases where teachers and other educational staff have filed lawsuits alleging hostile work environments due to racially charged interactions or patterns of harassment.

Courts may look for a pattern of discriminatory behavior or clear evidence that the conduct had a racial component and was not simply a misunderstanding or isolated incident.

      What to Do

Incidents should be reported to school administration and documented.

If the administration does not resolve the situation, a complaint can be filed with the Equal Employment Opportunity Commission (EEOC).

Legal counsel familiar with employment and civil rights law can help assess whether the facts are strong enough to support a lawsuit.

In summary, if the incident appears racially motivated and contributes to a hostile or discriminatory work environment, it may form the basis for filing a lawsuit under anti-discrimination laws.

  4. PERVERTS ARE EVERYWHERE .. as awkward as men are about the bathroom HE KNEW WHAT HE WAS DOING AND WHY. When it comes out later that the teacher is a predator THE SCHOOL WILL BE TO BLAME. There’s noooooo reason for that grown man to be waiting behind someone using the bathroom ESPECIALLY A DAMN KIDS .. perverts perverts perverts

    1. If the teacher had entered the stall and stood inches away from him in a way that was creepy and violating his personal space instead of just standing at the door this man had left open because it’s not just weapons I imagine they are also checking if people are vaping or smoking and he didn’t know the man had a d**k in his hand because he didn’t invade his space enough to see that because you know full well if he had craned his neck to look over his shoulder that is exactly what this dude would have said instead of just repeating over and over and over that he stood behind me when he could have walked out and talked to me outside after I was done when that’s the whole point of checking the bathroom I imagine is to see if the students are trying to get up to something in the bathroom so of course he’s going to stand at the open door and observe whether there’s anything going on that he needs to deal with in a professional manner and the fact that he stood at the open door means nothing unless you’re saying he walked in to the stall with you and invaded your space and again it’s so lately obvious that didn’t happen because you would have been the first one to start mentioning it and yet all you ever said is he stood behind me as if that projection of the accusation so heinous that it’s not an innocent it’s predatorial that’s the predatorial behavior is trying to destroy someone who you could have also just identified yourself to them as soon as they asked and said yeah I’m a sub today sorry can you give me some space or something like that and I bet it would have been over but you’re a piece of shit that just wanted to create drama and destroy someone the way that a predator behaves towards other human beings because they do not care about anyone but themselves and whatever clicks they can get and cloud or monetized videos you are a sad and disgusting individual that should be ashamed of the way you behaved in a place of learning so you could exploit a situation through lies and manipulation and you know exactly what you did and I hardly believe that every one of these comments is from someone that isn’t you since you probably created half these profiles trying to stir up the same drama that you needed from the situation from jump that’s what you were going for the entire time regardless of whether he was innocent you did not give a shit

      1. So he didn’t invade his space but was able to see from outside the stall that he didn’t have a lanyard or id??? Cause that’s his words. He went into the bathroom saw the guy in stall and saw he didn’t have identification. I’m sorry I’m not seeing all that from outside the stall with someone’s back to me be fr. Also he said he thought it was a student. You’re comfortable with that fact that had it been a student he would’ve been standing behind him as well while he’s exposed? This should not have happened at all and yall need to stop letting the race shit blind you.

      2. He stood at the stall door while the sub was peeing attempting to interrogate him. There is no place to go in a stall so the sub was trapped and cornered. The teacher wasn’t wearing an ID on visible display either so the sub also had no idea who this guy standing behind him was.

Many guys don’t close stall doors if taking a pee because they treat it as a defacto urinal that never have doors. This is normal.

The teacher failed to ID himself verbally until well beyond normal if this was mere authority check. I’m with those who think that teacher may have issues which should be addressed.

The failure of other staff to do more than close ranks shows a need for sensitivity training. The fact there were mainly white teachers present leads me to believe there is a deeper issue as well.

The black principal entirely failed to be impartial and represent the sub as an equal staff employee which is that principals failure of duty. The sub definitely has grounds for lawsuit.

    2. Love how they stand behind the Perv… Why isn’t everyone else wearing a badge with their name on it?

lawsuit just waiting to blow up

  5. Even if it was student, you couldnt have waited in the hallway and waited until the person came out of the stall? He had his dck in his hand actively using the restroom! Like wtf! What if it was a student?! That’s what makes this even more weird! This is why people don’t speak out about stuff like this because all you’re going to do is dismiss or excuse obvious perverted behavior! This student should not be around any children!

  6. His actions were wrong, what happened to having walkie talkies by the staff members? So this doesn’t make sense, if he wasn’t a sub, what’s going on with security that would allow someone other than teachers to walk into the staff’s restroom?

  7. Terrance Im with you when you’re right he could have called the principal or a resource officer dont they have a rooster of who is teaching in the school for that day its crazy to make the sub go home someone asked him to come there why not make the pervert go home pending investigation I know that might be hard to do because there is a shortage of qualified teachers out there but im a behavior health nurse there also is a shortage of us but we dont get to mistreat patients when will these school personnel I want call them all teachers because some are not certified be held accountable for their actions

  8. Angry Grandparent

I can believe this my granddaughter goes to EB Aycock and is in the 6th grade she was bullied by two teachers in school suspension out of school suspension and wasn’t allowed to go on a field trip with her classes all because the teacher asked for her cell phone she gave it to her and told her she wasn’t a teacher and she is not I guess she might be going to school to be one but just because she got in her little feelings some of the teachers at EB Aycock continue to do little sneaky get back stuff which tried to hurt a child for telling the truth and the assistant principal went along with the punishments my granddaughter is a A B student and also was told she couldn’t go to the academic breakfast tge school sent the letter home stating the 6th grade teacher was not a teacher then punish the student calling it disrespectful for stating fact no stop hiring these immature teachers with their immature friends bring back the teachers and principals we had in the 70’s, 80’s and early 90’s who actually was able to communicate with the parents without trying to ruin the child Earnest McNair at NPH was the best that ever did it.I know this is not about me but this was a chance for me to tell my story about what happened at EB Aycock with my granddaughter and is still going on grown or half grown a*s teachers sit back and taunt a 12 year old then punish them for telling the truth.I believe this substitute teacher it wasn’t about a badge it was about what was going through that little brain of his and his little friend and the school went along with it because they all have formed a little click to look out for one another whether right or wrong because we dont have qualified teachers to teach get this pervert out of the High School teaching our children

  9. With so many people invading schools and shooting people. I think he acted appropriately. Also if he had did nothing and something happened, people would be asking why he didn’t say something.

    1. That’s not an excuse ma’am, he should have stood by the door and waited for him to finish. They could have easily walked to the office and cleared everything up

    2. Lasheree Mcdowell

Problem with that is if it was actually a student and they decided to tell their parents I can see this going left for the teacher if they were to claim sexual harassment of some sort, it probably is best practice to either wait until they are done, call it in over the walkie talkie if your unsure or hell even talking from the door not behind him.

    3. He could’ve waited outside the door. Either way the substitute would have had to exit the bathroom. What if that was a student using the bathroom. That is inappropriate.

    4. He can’t hold a weapon and urinate at the same time. So the teacher acted inappropriately questioning that man in a vulnerable moment. Would you want a teacher watching your child use the bathroom? He thought it was a student so does that mean watching him pee is ok to you?

    5. There is a world of difference between doing nothing, and doing what they did. People always want to act like context and details don’t matter.

    6. How could you be disgusting like that? The man was actively peeing (pee hitting water sound can be heard), to stand behind while he is doing that is disgusting, predatory, unprofessional, concerning as a parent to students and should be investigated. The Herring dude clearly said that he was unable to identify a lanyard or student ID which means he was not only standing behind him while peeing but also optically searching the person, this is not ok and you can’t be either.

  10. Terrance Dillahunt

Really, if the sub was actively using the bathroom, even if it was a student why would the teacher stand behind him, what was he gonna do, stop him in mid peeing, no no the teacher had other things on his mind, teacher was hoping he bind over to pick up the soap!!! I dont give a damn the teacher could’ve waited until the person came out of the bathroom then confronted them..

    1. That’s right sir, the proper thing to do is wait by the door. They could have easily walked to the office and cleared everything up. What if it had not been a teacher and he just turned around and started firing?
